Regulations for Computer Contracts
This regulation is considered accepted by the user at the time of placing the order, as an integral part of that order.
Premise
The user who registers on the PhotoWorld.it website is required to accept these regulations, to enter their personal data accurately, and to update it if it is no longer truthful.
Pornographic images and material will be immediately reported to the judicial authorities, and the user's data will be provided along with the reported material.
Privacy Policy
In accordance with Article 10 of Law 675/96, PhotoWorld.it declares that the data collected here are intended for user registration and to activate an information service for the user. This data will be processed electronically in compliance with current laws, may be communicated to the management of the service in question, and will be disseminated exclusively within the scope of the service provided. The data subject has the rights provided for in Article 23 of Law 675/96. The owner and manager of the collected data is Ermanno Montuori – via Indipendenza 250 – CAP 84051 Palinuro di Centola – SA – TEL 0974/930963. Liability Limits PhotoWorld.it is committed to maintaining the confidentiality of photos published on the site. Only the user will be able to access their own photos. In any case, PhotoWorld.it is not liable if, due to technical problems or issues caused by viruses or network attacks, some photos are made visible by users other than the legitimate owner. The PhotoWorld.it site is not intended as a container/storage for submitted photos. Submitted photos will be kept for a duration at the discretion of PhotoWorld.it and may be removed from the server at any time without any explanation to the legitimate owner. PhotoWorld.it is not responsible for the accidental deletion of published photos due to errors by its personnel or problems or errors from its hosting provider. PhotoWorld.it is not responsible for the loss of photos during the shipping phase or for delays in delivery compared to the expected times. Shipping is carried out by services of another operator, chosen at the discretion of PhotoWorld.it.
Production times
Orders will be processed on average within 72/96 hours of the order being placed. This period will commence from the moment Photoworld.it receives confirmation of payment credit at their bank, as further specified in the “payments” section. Actual production times depend on the type of print and/or product and the chosen shipping method. The production time for each product is indicated on its product page, viewed before purchase. The indicated time is purely an estimate: PhotoWorld.it disclaims any responsibility for delays and/or disruptions due to unforeseen circumstances or technical issues.
Delivery times
Fulfillment by Photoworld.it will occur upon delivery of the merchandise to the courier, who will then arrange for its delivery. Photoworld.it is not responsible for failure to meet delivery times. Errors, delays, and losses related to courier shipment are not attributable to Photoworld.it, but to the courier itself.
Shipping is at the buyer's expense from Photoworld.it. in the name and on behalf of the customer, via courier of our exclusive trust. Photoworld will notify the customer by email of the actual date of delivery of the product to the courier.
Delayed Orders
Photoworld offers the possibility to purchase orders as backorders, making the full payment for the product immediately and sending the files for printing by the maximum deadline indicated on the product's public page and/or during the ordering process and/or in the order confirmation email and/or on the order summary page within your personal profile on the site. The deadline for sending files is mandatory and, if not met, will result in the cancellation of the order with no possibility of refund by the customer. Photoworld has no obligation to communicate the approaching deadline or the actual order expiry date, but reserves the right to send informational emails or other communications regarding it. It is solely the customer's responsibility and interest to send the files by the scheduled deadline for the order. Photoworld also reserves the right, at its discretion, to extend the deadline for an order and therefore to consider it still valid after the scheduled expiry date, even upon payment of an amount to cover reactivation costs.
Payment methods
Photoworld.it will be obligated to fulfill its duties only after payment has been received. Payment will be considered received when Photoworld.it confirms the credit of the sale price into its bank account.
In the event that payment is made by cash on delivery, any refusal of the package does not exempt the buyer from the obligation to pay the price of the goods sold as per the order placed and confirmed via email or according to the procedures indicated on the website. Therefore, Photoworld.it, in case of refusal of the package, may legally demand payment for the price of the goods sold.
Seller's break
Photoworld.it shall have the right to withdraw from the contract until its bank confirms the crediting of the sale price of the goods. This confirmation must occur within 30 days of the order date.
The user releases Photoworld from any liability arising from violation of copyright law and from any content that may defame and/or offend a third party, assuming full and total responsibility for the publication of their images on the site.
Tax Aspects
For amounts exceeding €29.00, the user may request an invoice at the time of order using the appropriate form. In this case, the user must provide all tax information in advance. If no prior request is made, we will not issue an invoice. The product will not be accompanied by a fiscal receipt, as the registration obligation is fulfilled virtually.
For certain products that can only be accessed digitally online (software downloads, etc.), an invoice will be mandatorily issued. This invoice will be available exclusively in electronic format (PDF) and sent via email, as well as being downloadable from the dedicated invoices area of the website. It will subsequently be the responsibility of the customer receiving the invoice to print a copy and retain it in accordance with their accounting procedures. For the management of this invoicing method, please refer to the current regulations regarding “electronic invoicing” and related decrees and regulations.
Cooperation with judicial authorities
PhotoWorld.it reserves the right to send any material published on the site to judicial authorities, should they make an explicit request. PhotoWorld.it reserves the right to report any abuse depicted in photos submitted to the site to judicial authorities. In particular, photos containing images of acts that violate human dignity and/or mistreatment of minors will be immediately reported to the judicial authorities.
Service Security
PhotoWorld.it uses the best technologies available on the market. Nevertheless, PhotoWorld.it's servers cannot be considered an image bank. PhotoWorld.it reserves the right to delete some or all images from its servers if necessary for technical or security reasons.
Any attempt to attack or breach the security systems, restricted access areas, and databases containing personal data and confidential material will be reported to the provider and the competent judicial authorities.
Pickup at Pick Point
Pick-up at our pick-up points incurs an additional fee, indicated during the checkout process for each order placed on photoworld.it. Orders must be placed, paid for, and managed entirely online, including photo submission. Order consolidation fees for different formats will also apply, at a rate of €1.90 for each order with a different format or paper type.
RIGHT OF WITHDRAWAL (pursuant to Legislative Decree 206/2005)
Photoworld recognizes the right of withdrawal from your purchase, according to the terms established by current law.
Money-back guarantee: As provided by law, the user has the right to withdraw from the purchase within 10 days of receiving the product at their address (the delivery data recorded by the courier is valid).
Withdrawal rights policy
To exercise the right of withdrawal, it is necessary that:
– the customer must express their willingness to exercise the right of withdrawal by sending an email to amministrazione@photoworld.it or a registered letter with return receipt to Photoworld.it – via indipendenza, 250 – 84051 Palinuro (SA), indicating their username and order number for which they intend to exercise the right of withdrawal. The customer is not required to provide a reason for their choice.
– The purchased item must be returned intact and in its original packaging without any tampering or damage, including any transport documents, invoices, and receipts that were enclosed.
Return shipping costs are the responsibility of the Customer, who may choose their preferred shipping method. The package must be returned no later than 10 days from the opening of the withdrawal request (via email or registered mail with return receipt).
In the case of damaged prints due to reasons not attributable to Photoworld but rather to the poor quality of the file generated by the client, Photoworld will not be held responsible in any way.
In particular, we will not accept returns due to discrepancies between the printed colors and the colors displayed on the customer’s monitor, discrepancies between the photo’s aspect ratio and the selected format, incorrect selection of cropping options, files sent by the customer that are damaged, previews approved by the customer containing incorrect content, or photo books whose actual size is larger or smaller than that specified for the 5% product and for which this variation has resulted in the cropping of text and images placed within the technical margins indicated on the website.
In the event that the package has been damaged during shipping, the customer, to obtain the rights provided for by the withdrawal regulation, must accept the package from the courier with reservation and in any case open a dispute with the courier responsible for the delivery. Photoworld will provide all the necessary information regarding this procedure.
After the package is returned to our facility and we have verified its integrity and the products contained within, we will refund the full order amount and the shipping costs incurred via bank transfer, which will be processed within 30 days of receiving the merchandise at our facility.
Products excluded from the right of withdrawal
In accordance with the law, customized products do not allow for the benefit of the right of withdrawal: therefore, photographic prints, photobooks, personalized gadgets, canvas prints, or anything else that has been created exclusively to measure and in any case clearly personalized for a specific user and therefore not resalable or reusable, will not be eligible for the right of withdrawal, and Photoworld will not be held liable for any compensation, even if requested by the customer in the manner previously indicated (Legislative Decree 206/2005, Article 55).
Therefore, only non-customized goods (such as those available in the shop: frames, photographic equipment, consumables, etc.) can benefit from the right of withdrawal.

Not satisfied with your custom product? We'll reprint it. If your product is not among those that are legally exempt from the right of withdrawal (all personalized products), but you are not satisfied with the result, you cannot request a refund for the product. Instead, you can request a reprint or credit to your wallet for the amount corresponding to your order, to be spent on Photoworld for the purchase of other photographic products. The wallet credit will not be refundable in any case.
You can request a reprint by contacting us exclusively at amministrazione@photoworld.it, indicating your user number, order number, and the reasons for your request. Photoworld will evaluate whether to accept the request and if it is necessary for the customer to send back the package with the product to be reprinted for appropriate checks. Photoworld may, as an alternative, request only the submission of photographic documentation related to the problems encountered.

Photo albums
The digital photo book is a product made with the latest generation of automated machines, but the production process remains exclusively artisanal. This makes each product always unique and different. The printing is achieved through chemical development in RGB color mode.
Before proceeding with printing, Photoworld commits to sending a graphic preview of the photo book. This step aims only to identify and confirm the exact sequence of files (page 01, page 02...). Small defects and minor imperfections will not be detectable at this stage due to the resolution that internet monitors provide (72 dpi for Windows, 96 dpi for Mac). Without confirmation of the graphics, the lab will not proceed to the next printing phase.
Each component of the kit may differ from the others, whether in terms of printing, binding, type of materials, or print colors. Differences in prints may also occur on the same files, whether printed at earlier or later times (a characteristic of chemical printing). While maintaining maximum precision, the use of geometric graphics with borders and frames at the edges of the pages is not recommended.
Right of withdrawal: as the Photo Book falls into the category of personalized products, it cannot be considered a product eligible for withdrawal as a “sine qua non” principle. For commercial choices, Photoworld allows the right of withdrawal before the “FILE CHECK” status. All products on offer or in flash sale mode are excluded from the right of withdrawal.

Contents of the Package: Inside each box, a summary document of the goods sent will be included. The contents describe all products shipped from the laboratory and the signature of the operator or operators who produced it.
Goods receipt:
Upon delivery of the merchandise by the courier, the Customer is required to check:
that the number of packages to be delivered matches what is indicated on the transport document;
2: the packaging is intact, undamaged, not wet, or otherwise altered, even in the sealing materials (adhesive tape or metal straps).
Any damage or discrepancy in the number of packages or indications must be immediately reported to the courier making the delivery, by writing ”Goods inspection reservation” on the appropriate accompanying document and confirmed immediately by registered mail with return receipt to: PhotoWorld.it via indipendenza 250, CAP 84051 Palinruo di Centola (SA). Otherwise, Photoworld will not be responsible for any compensation or reprints.
If you accept the merchandise delivered by the courier without noting any necessary reservations, you will not be able to claim any shortages or damages due to transport from PhotoWorld.it at a later time, but exclusively from the courier.
We also specify that the following wording, “Collo integro accetto con riserva di controllo” (Package intact, I accept with reservation of inspection), is not taken into consideration by the courier, who therefore does not accept claims or damages. Thus, inspection must be carried out on the spot with the courier. Any hidden anomalies (e.g., theft or shortages) must be reported in writing by registered mail with return receipt addressed to PhotoWorld.it within seven working days. Any notification beyond the aforementioned deadlines will not be taken into consideration. For every declaration, the Customer assumes full responsibility for what is declared.
Reprints
The photos exhibiting the following defects will not be reprinted:
- mismatch between print colors and the client's monitor colors;
– mismatch of photo proportions to the chosen format;
– no match of personal color profiles with the laboratory's color profiles;
- mismatch between print colors and the client's monitor colors;
– mismatch of photo proportions to the chosen format;
– files damaged by the customer during processing;
In case of photos to reprint:
Resend the photos and the document titled “ENVELOPE CONTENTS” to Photoworld, via Indipendenza 250, CAP 84051 Palinuro di Centola (SA).
Shipping photos to and from the lab is the customer's responsibility at a cost of $19.00 via express courier.
Once responsibility for the damage has been verified, the photos will be reprinted and the shipment will be fully refunded via bank transfer, PostePay top-up, or credited to your personal wallet.
In case of an error not attributable to the laboratory, the customer will therefore have to pay for both outbound and return shipping.
Online Dispute Resolution for Consumers:
The consumer residing in Europe should be aware that the European Commission has established an online platform that provides an alternative dispute resolution tool. This tool can be used by European consumers to resolve any disputes relating to and/or arising from online purchase agreements for goods and services out of court. Therefore, if you are a European consumer, you can use this platform to resolve any disputes arising from an online contract concluded with the Owner.
